Welcome to LeadSpotter ("LeadSpotter," "we," "us," or "our"), a service operated by PK Industries. These Terms of Service ("Terms") govern your access to and use of tryleadspotter.com and related services (the "Service"). By subscribing to or using the Service, you agree to these Terms.

1. Description of Service

LeadSpotter is a lead-generation tool designed for freelance web designers and agencies. The Service searches for local businesses that do not have a website listed on their Google Business Profile or Google Maps listing, and generates AI-written cold email pitches for outreach. A business flagged by the Service may still have a website that is not linked to its Google listing. Results are delivered via a Google Sheet linked to your account.

2. Accounts and Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your access link and any credentials associated with your account, and for all activity that occurs under your account.

3. Subscription Plans, Billing, and Automatic Renewal

• LeadSpotter offers subscription plans (Basic $29/month, Standard $49/month, Pro $97/month), billed monthly through Stripe, our third-party payment processor.
• By subscribing, you authorize us to automatically charge your payment method the plan price shown at checkout on the same day each month, on a recurring basis, until you cancel.
• Your subscription will continue and automatically renew for successive one-month terms at the then-current price unless you cancel before the next billing date.
• Prices and plan features are as described on our pricing page at the time of purchase. If we change the price or features of your plan, we will notify you by email in advance of the change taking effect on your next billing cycle, and you may cancel before that renewal if you do not agree to the new terms.
• How to cancel: You can cancel your subscription at any time, at no cost, through the self-service customer billing portal linked in your welcome email and account communications. Cancellation takes effect at the end of your current billing period, and no further charges will be made after that date.

4. Cancellations and Refunds

• You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period, and you retain access to the Service until then.
• We offer a 7-day money-back guarantee on new subscriptions, valid only if fewer than 3 searches have been used during that period. To request a refund under this policy, contact us at leads@tryleadspotter.com within 7 days of your purchase.
• Refunds are not available for partial months, unused searches beyond the guarantee period, or after the 7-day window has passed.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose, including spam or unsolicited bulk email in violation of CAN-SPAM, GDPR, or similar laws in your jurisdiction.
• Attempt to circumvent usage limits, share access credentials to bypass plan limits, or resell access to the Service without our written permission.
• Use the Service to harvest data for purposes unrelated to legitimate business outreach.
• Interfere with or disrupt the Service, its infrastructure, or other users' access to it.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Lead Data and Accuracy

LeadSpotter uses automated tools, including third-party APIs (such as Google Maps) and AI-generated content, to identify businesses and draft outreach emails. We do not guarantee:

• The accuracy, completeness, or currency of any business information provided.
• That any business identified as "without a website" is accurate at the time you receive results.
• The performance, response rate, or outcome of any cold email generated by the Service.

You are responsible for reviewing and personalizing any AI-generated content before sending it, and for complying with applicable anti-spam and marketing laws when contacting leads.

7. Intellectual Property

The Service, including its software, design, and underlying technology, is owned by PK Industries. Lead data and generated email drafts delivered to you are yours to use for your own business outreach purposes.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the fullest extent permitted by law, PK Industries and LeadSpotter shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost business, lost revenue, or damages resulting from inaccurate lead data or the outcome of outreach emails. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 3 months preceding the claim.

10. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes to these Terms will be communicated via email or posted on our website with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or other reasonable cause. You may terminate your account at any time by canceling your subscription.

12. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles, unless otherwise required by applicable law in your jurisdiction.
